1. General Provisions
These terms and conditions of purchase (hereinafter – Terms), once confirmed by the Buyer (by checking the box confirming agreement with the "balticprotein.lt" terms when purchasing goods), constitute a legally binding document for both parties, establishing the rights and obligations of the Buyer and the Seller, the terms and conditions for purchasing and paying for goods, delivery and return procedures, the liability of the parties, and other provisions related to the purchase and sale of goods in the "balticprotein.lt" online store (hereinafter – Store).
The Seller reserves the right to change, amend, or supplement the Terms at any time, in accordance with the requirements established by legal acts.
2. Protection of Personal Data
Any information related to personal data and registered in the Store is considered confidential and is not disclosed.
When ordering goods in the Store, the Buyer must provide the data requested during registration.
The Buyer is responsible for providing correct data during registration.
By placing an order, the Buyer agrees that their personal data provided will be processed for the purposes of order management and activity analysis. The Buyer also agrees that information notifications necessary for the fulfillment of the order will be sent to the email address or phone number provided by the Buyer.
By registering in the online store and ordering goods, the Buyer undertakes to protect their login credentials and not to disclose them to anyone.
The Seller undertakes not to disclose the Buyer's personal data to third parties, except in cases provided for by the legal acts of the Republic of Lithuania.
3. Buyer's Rights
The Buyer has the right to purchase goods in the Store in accordance with these Terms.
The Buyer has the right to withdraw from the purchase-sale agreement concluded with the Store by notifying the Seller via email or phone.
4. Buyer's Obligations
The Buyer undertakes to pay the agreed price for the goods, indicating the exact payment purpose, and to accept them in accordance with the procedures set forth in these Terms.
The Buyer undertakes to select the appropriate size of the item, for which the Buyer is personally responsible.
The Buyer undertakes not to transfer their login credentials to third parties. In the event of losing login credentials, the Buyer must immediately inform the Seller.
By placing an order in the balticprotein.lt online store, the Buyer agrees to these purchase-sale Terms and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
5. Seller's Rights
If the Buyer attempts to damage the stability and security of the Store or violates their obligations, the Seller has the right to immediately and without notice limit or suspend the Buyer's access to the Store or, in exceptional cases, cancel the Buyer's registration.
The Seller has the right to cancel the Buyer's order without prior notice if the Buyer does not pay for the goods within 3 (three) working days.
6. Seller's Obligations
The Seller undertakes to respect the Buyer's right to privacy regarding their personal information provided in the Store's registration form and not to disclose the obtained data to third parties, except in cases established by the legal acts of the Republic of Lithuania.
The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions set out in clause 8 of the Terms.
If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, the Seller undertakes to offer an analogous or as similar as possible product. If the Buyer refuses to accept the analogous or similar product, the Seller undertakes to refund the money paid by the Buyer within 3 (three) working days, if an advance payment was made.
7. Ordering, Payment Procedures and Terms
The Buyer can shop in the online store 7 days a week, 24 hours a day. Orders by phone or email are accepted during the specified working hours, which are indicated in the contacts section of the website.
The Buyer can pay for the goods using an electronic banking system. The Buyer transfers funds to the balticprotein.lt current account. In this case, responsibility for data security lies with the respective bank whose electronic banking system is used to carry out monetary transactions.
The Buyer undertakes to pay for the order within 3 days from the date of order confirmation. The preparation of the shipment begins only after receiving payment for the goods.
If the Buyer does not make the payment within 3 days, if only part of the money is transferred, or if the payment purpose is specified incorrectly, the order is cancelled. If the money has been transferred to the balticprotein.lt bank account, it will be returned to the Buyer within 14 days.
If the Buyer purchases a gift voucher and does not use it within the period specified on the voucher, it is considered that the voucher has been used.
8. Delivery of Goods
When ordering goods, the Buyer undertakes to specify the exact delivery location and contact phone number.
The Buyer undertakes to accept the goods personally. In the event that the Buyer is unable to accept the goods personally and the goods are delivered to the specified address, the Buyer has no right to make claims regarding the delivery.
The goods are delivered by the Seller or an authorized representative (postal or courier service). The Seller is not responsible for poor service by Lithuanian Post or courier services.
The Seller undertakes to deliver the goods in compliance with the delivery terms, except in cases where the Seller does not have the goods in stock.
The Seller is released from liability for violations of delivery terms if it occurred due to the Buyer's fault or due to circumstances beyond the Buyer's control.
9. Quality and Return Conditions
The Seller is not responsible if the color, shape, or other parameters of the goods do not correspond to reality due to the characteristics of the screen used by the Buyer.
Goods cannot be returned if they are unsuitable for the Buyer due to an inaccurate choice made by the Buyer themselves.
The return of goods is carried out in accordance with the legal acts of the Republic of Lithuania.
The Buyer must send the returned goods by registered mail via Lithuanian Post. The shipping costs are paid by the Buyer.
If the Buyer wishes to return a high-quality product, they may do so within 14 days from its delivery.
The exchanged or returned item must be in its original packaging, undamaged, and unused.
The Seller has the right not to accept the item if it does not meet the requirements of the return procedure.
Money for returned goods is refunded within 14 days from the date of their receipt.
If a defective (faulty) item was received, the Seller shall replace it or refund the money and compensate for the return costs.
10. Liability
The Buyer is fully responsible for the accuracy of the data provided in the registration form.
The Buyer is responsible for transferring their login credentials to third parties.
The Seller is released from liability if losses arise because the Buyer did not familiarize themselves with these Terms.
The Seller is not responsible for the information or activities on third-party links within the Store.
In the event of damage, the party at fault or their representatives shall compensate the other party for the direct losses incurred.
11. Final Provisions
This agreement enters into force from the moment of payment for the goods.
These Terms are drawn up in accordance with the laws of the Republic of Lithuania.
All disputes arising from the implementation of these Terms shall be settled through negotiations or in accordance with the procedures established by the laws of the Republic of Lithuania.
